This is a translation for your convenience. The binding version of these Terms is the Spanish one, available at qlesspark.com/terminos-condiciones. In the event of any discrepancy or conflict between the two, the Spanish version prevails.

These Terms govern your access to and use of all the content, Product and Services available at the website https://www.qlesspark.com (the «Service»), operated by Qless Park («we», «us» or «our»).

Your access to our services is subject to your acceptance, without modification, of all the terms and conditions contained in this document and of all other operating rules and policies published, and which may be published from time to time, by us.

Please read the Agreement carefully before accessing or using our Services. By accessing or using any part of our Services, you agree to be bound by these Terms. If you do not agree to any part of the terms of the Agreement, then you may not access or use our Services.

Intellectual property

The Agreement does not transfer from Us to you any intellectual property belonging to Us or to third parties, and all rights, title and interest in such property shall remain (as between the parties) solely with Qless Park and its licensors.

Third-party services

In using the Services, you may use third-party services, products, software, embeds or applications developed by a third party («Third-party services»).

If you use third-party services, you understand that:

• Any use you make of third-party services is at your own risk, and we will not be and shall not be held responsible for them.
• Furthermore, you acknowledge and agree that we shall not be liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with the use of, or reliance placed on, any content, goods or services available on or through any such site or resource.

Accounts

If you need an account to use our Services, you agree to provide us with complete and accurate information when registering.

You will be solely responsible for any activity that occurs under your account. You are responsible for keeping your account information up to date and for keeping your password secure.

You are responsible for maintaining the security of the account you use to access the Service. You must not share or misuse your access credentials. You must notify us immediately of any unauthorised use of your account, or upon becoming aware of any other breach of security.

Links to other websites

Our Service may contain links to third-party websites or services that are not owned or controlled by Qless Park .

Qless Park accepts no responsibility for the content, privacy policies or practices of third-party websites or services. You further acknowledge and agree that Qless Park shall not be liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with the use of any content, products or services available on or through any third-party website.

We strongly recommend that you read the terms and conditions and the privacy policies of any third-party website or service you visit.

Termination

We may terminate your access to all or part of our Services at any time, with or without cause and with or without notice; such termination shall take effect immediately.

If you wish to terminate the Agreement or your Qless Park you may simply stop using our Services.

All provisions of the Agreement which by their nature should survive termination shall do so, including but not limited to ownership provisions, warranty disclaimers, indemnities and limitations of liability.

Disclaimer

Our Services are provided «AS IS.» and «AS AVAILABLE». Qless Park and its suppliers and licensors disclaim all warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose and non-infringement. Neither Qless Park nor its suppliers or licensors warrant that our Services will be error-free or that access to them will be continuous or uninterrupted

You understand that you download from our Services, or otherwise obtain content or services through them, at your own account and risk.

Right of withdrawal

If you are buying as a consumer, you have fourteen (14) calendar days from confirmation of your purchase to withdraw from the contract, without giving a reason and without penalty.

The service consists of calculating and delivering a personalised itinerary from the information you give us, so performance does not begin on payment: it begins when you expressly ask us to generate your itinerary, by pressing "Create itinerary" in your client area.

By pressing that button you expressly request that we begin performing the service before the withdrawal period ends, and you acknowledge that once the service has been fully performed you will lose your right of withdrawal, under article 103.a) of the consolidated text of the Spanish General Law for the Defence of Consumers and Users.

Until you press "Create itinerary", and within those fourteen days, you may withdraw by writing to info.qlesspark@gmail.com and we will refund you in full. No form and no reason are needed.

In short: your right lasts fourteen days, or until you ask us to generate the itinerary, whichever comes first.

Jurisdiction and governing law

The Agreement and any access to or use of our Services are governed by Spanish law.

In the event of a dispute with a consumer, the courts and tribunals of the consumer's place of residence shall have jurisdiction.

Changes

Qless Park we reserve the right, at Our sole discretion, to modify or replace these Terms at any time.

If we make changes that are material, we will let you know by posting on our website or by sending you an email or other communication before the changes take effect. The notice will designate a reasonable period of time after which the new terms will take effect.

We will endeavour to give at least 30 days’ notice. If you do not agree with the changes, you must stop using our Services before the end of the period stated in the notice or once our changes take effect.

If you continue to use our Services, you will be bound by the new terms.
